Eviction legislation is a deceptively complex area of law. WHO CAN USE THIS SERVICE? The short answer is most standard Assured Shorthold Tenancies post 2004 which are paid calendar monthly, but please see the checklist below. 

  • Landlords (or their agents) with a standard Assured Shorthold Tenancy (AST) complying (in the case of Section 21 Notices) with the security deposit legislation (i.e. using a recommended deposit scheme) - That means nearly all tenancies post 2004 can benefit from our service.  Landlords with an Assured tenancy can use our service to create a section 8 notice     

 

  • The rent must be payable calendar monthly for the automated process to work, unless the fixed term has not expired and you are not seeking possession based on a breach of the tenancy.

 

  • At present the service does not cover breaches of the tenancy other than arrears of rent.

 

Description of our service:

1. This service is intended to provide correct legal notices that will not result in the stalling of your eviction process because of procedural errors, errors in the Notice, or your failure to comply with mandatory legal requirements.

2. The service will compute the Notices you need based on the information you enter.

3. You will be able to choose what Notices to pay for, and you will be immediately taken to a area on the website where you can download the completed notices and advice in PDF format. You will also emailed all the same notices, to ensure delivery.

4. We will provide advice on when and how to serve the notice and advise you of relevant deadlines and procedures. Joe Chiffers LLB, a solicitor specialising in this area of law, will personally answer any questions you may have. 

5. This automated process will cover evictions based on rent arrears (section 8 notice), or simply removing a tenant when the tenancy has expired (section 21 notice), by serving a legally valid Notice.  We will also provide you with the relevant eviction procedure and advice.  

6. Exclusions:
